Terms of business and legalities
Highphotospain usually enters into a verbal contract with its clients, however in some cases details of the agreement may be confirmed in writing prior to undertaking the work. Highphotospainshall not be liable to the customer for any failure, in whole or in part, to fulfill its obligations under the agreement where failure arises as a result of an event or circumstances beyond its control, which may include (but are not limited to) equipment failure, unsuitable weather conditions, illness or injury.
The client has the right, as we do, to cancel the agreement prior to carrying out the work due to unsuitable weather conditions, however, sufficient notice must be given. We will not accept cancellations once we have been on site and the photographs have been taken - the cost of the work will be charged to the client as originally agreed.
If the equipment is to be operated on or near to public highways, footpaths or other public areas permission may be required, and suitable safety signs will be used. Permission to operate the equipment on private property will be sought. Under all circumstances, the area in which we operate will be coned off and the operator will wear an appropriate high visibility jacket.
In all cases we will observe rights of privacy.

Weather conditions
While we do our utmost to carry out the work in the most suitable weather conditions, we are not responsible for weather forecast inaccuracies. We schedule our work around the regional forecasts.
We are unable to erect the mast in rain and in wind speeds greater than 30 mph. Guy ropes for support are not needed in lighter winds (up to 15 mph), however, our policy is to use them at all times.
When scheduling work, quality and direction of light are also considered.
We will advise in all cases on appropriateness of the weather. If conditions are unfavorable, we will do our best to re-schedule and to carry out the work as soon as weather permits.
Copyright
Highphotospain retain copyright of all images taken but reproduction rights are transferred to the client. Clients are free to reproduce images as many times as is necessary and where appropriate should reference the images to Highphotospain. The client may not pass or transfer the rights of reproduction to a third party without written permission from Highphotospain. Third parties will be liable to pay a fee for using photos.
Payment terms
For private commissions, payment is required on delivery of the images, which in some cases may be on site, as soon as the photographs are taken and copied onto CD. Payment is acceptable only by cash. The resulting pictures can be burned to CD on site, or if further creative work is needed (building up a panoramic image for example) we will carry out that work back at our studio and supply you with the completed files later.
